In 2022, the California Legislature and Governor saw fit to modifying statutes designed to combat insurance fraud via AB 1681. This law creates a new role for California’s District Attorneys, as they can now convene meetings of insurers and self-insureds to discuss large fraud schemes throughout the state. Participants in these meetings are immune from civil liability, which opens up the possibility to proactively and expeditiously identify, investigate and fight major crime rings in California. This session will consider the import of this new law; discuss potential pitfalls in implementation for DAs, insurers, and the Department of Insurance; and propose ways that the various interested parties can help mitigate potential issues.
